Abstract: The Uniformed Services Employment and Reemployment Rights Act (USERRA) was signed into law to encourage noncareer military service, minimize service-related disruptions and prevent discrimination against service members. When a U.S. Army Reservist who’d been passed over for promotion sued his employer, claiming it had violated USERRA, the U.S. Court of Appeals for the First Circuit rejected his arguments — except one.
